A foreigner will be required to obtain a work permit before legally being able to work in Taiwan. An ARC and resident visa will be required to legally reside in Taiwan. These may generally be obtained through one of three means:

  1. Marriage. A foreigner married to a Taiwanese citizen may obtain residency and an open work permit based on that marriage.
  2. Employment. A company meeting minimum capital and annual revenue thresholds may employ foreign professionals if they fall within a prescribed profession and meet educational and/or work experience requirements. (The annual revenue requirement does not apply for the first year following a company’s establishment.) A work permit may be granted on the basis of that employment relationship. Once a work permit has been obtained then the foreign professional becomes eligible for residency and the ARC.
  3. Investment. An ARC may also be issued to foreign investors and representatives of foreign-invested companies where the paid-in foreign investment in practice exceeds US$200,000. No work permit is required rather special permission must be obtained from the Investment Commission. An ARC may then be obtained based on this approval.

Yes, an ARC may be obtained through your new company. The company may employ you if you satisfy the requirements for a work permit for the position. You may also be able to obtain an ARC if the paid-in foreign investment exceeds US$200,000.
